Terms of Service
These Terms of Service ("Terms") govern your access to and use of Examinerly ("we", "our", or "us"), an independent service operated by a single individual (a sole operator), not a registered company or incorporated entity. By using examinerly.com or app.examinerly.com (collectively, "the Service"), you agree to these Terms. If you do not agree, do not use the Service.
There are two distinct contractual relationships when you pay for the Service. Your purchase contract (payment, invoicing, taxes, and refunds) is with Dodo Payments, which acts as the merchant of record and is the seller on your payment statement. Your use contract (access to the grading service, your rights and obligations, and these Terms) is with the individual operator of Examinerly. This structure is what allows an individual operator to sell the Service globally: Dodo Payments handles the commercial and tax obligations on your behalf.
IELTS Trademark Notice
IELTS is a registered trademark of the British Council, IDP: IELTS Australia, and Cambridge Assessment English. Examinerly is an independent product and is not affiliated with, endorsed by, or connected to those organisations in any way. The band scores produced by Examinerly are AI estimates and are not official IELTS scores.
1. Description of the Service
Examinerly is an AI tool that reads an IELTS Writing essay you submit, estimates a band score, identifies the single assessment criterion most limiting that score, and suggests a sentence-level improvement.
The band score is an AI estimate, calibrated against real examiner-scored essays and typically within about half a band of a human examiner. It is not an official IELTS score, is not issued by any official IELTS organisation, and carries no guarantee of any result in a real IELTS examination. You should treat it as one data point in your preparation, not as a definitive assessment. AI output may be wrong. Use your own judgement.
2. Eligibility and Account Responsibilities
You must be at least 16 years old to use the Service. By using it, you confirm that you meet this requirement.
If you create an account, you are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us immediately at support@examinerly.com if you believe your account has been compromised.
You may only create one account per person. Accounts are non-transferable.
3. Acceptable Use
You agree not to:
- Submit essays containing personal data of third parties without their consent.
- Attempt to reverse-engineer, scrape, or extract the grader's prompts, models, or internal logic by automated or manual means beyond the permitted plan quotas.
- Use automated scripts, bots, or tools to submit essays at a rate that exceeds your plan's daily or monthly quota.
- Use the Service to generate content for any purpose that violates applicable law or the rights of others.
- Attempt to circumvent rate limits, Turnstile bot protection, or other security controls.
- Share, resell, or sublicense access to the Service to third parties.
- Attempt to gain unauthorised access to any part of the Service or its underlying infrastructure.
We reserve the right to suspend or terminate access for any violation of these rules.
4. Plans and Quotas
The Service is offered on the following plans:
- Free tier: 2 essay checks per day. No account required. Rate-limited by a hashed IP address. No payment needed.
- Pro plan ($9 per month): up to 50 essay checks per month, full diagnosis history, and all current features. Requires a paid subscription.
A higher-tier plan is planned for the future at a different price. Details will be published when available.
Unused checks do not roll over between billing periods. Quotas apply per account (or per hashed IP for the free tier).
5. Billing, Cancellation, and Refunds
Paid subscriptions are billed monthly through Dodo Payments, which acts as the merchant of record and the seller on your payment statement. Dodo handles all payment processing, applicable taxes (VAT, GST), invoicing, and refund disbursement on behalf of the operator. Examinerly does not receive or store your card number or other payment credentials. Because Dodo Payments acts as merchant of record, your payment relationship is with Dodo, not with the individual operator.
You may cancel your subscription at any time via your account settings or by contacting us. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then.
Refunds are handled in accordance with Dodo Payments' merchant-of-record refund policy. In addition, we will consider refund requests made within 5 days of a charge if you have not substantially used the Service in that period. Contact us at support@examinerly.com to request a refund.
6. Intellectual Property
You retain all rights to the essays you submit. By submitting an essay, you grant us a limited, non-exclusive licence to process it through our AI systems solely to deliver the Service to you.
Examinerly, including the product design, interface, grading system, and all content we produce (other than your essays), is owned by us and protected by intellectual property law. You may not copy, reproduce, or redistribute any part of the Service without our prior written permission.
The grader's prompts, internal logic, and anchor materials are proprietary and confidential. Any attempt to extract or reproduce them is a breach of these Terms.
7. Public Share Pages
You may opt in to creating a public link for a graded report. Once you create a public link, anyone with that link can view the report. You are solely responsible for the content of essays you choose to make public. We may remove public pages that violate these Terms or applicable law.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or accuracy.
We make no guarantee that the AI band estimate will match your score on any real IELTS examination. AI output may be wrong. You are responsible for evaluating the output and using it as one tool among many in your preparation.
We do not guarantee uninterrupted or error-free availability of the Service.
9. Limitation of Liability
To the fullest extent permitted by law, the individual operator of Examinerly will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to: reliance on an AI band score, an exam result that differs from an Examinerly estimate, or loss of data.
Our total liability to you for any claim arising from these Terms or the Service will not exceed the amount you paid us in the 12 months before the claim arose, or $50, whichever is greater.
Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, our liability is limited to the minimum extent permitted by law.
10. Termination
You may stop using the Service at any time. You may delete your account via account settings.
We may suspend or terminate your access if you breach these Terms, if continued access creates legal or security risk, or if we discontinue the Service. Where feasible, we will give you notice before termination.
Sections 6, 8, 9, and 11 survive termination.
11. Governing Law and Disputes
These Terms are governed by the laws of India (the country where the individual operator resides), without regard to conflict-of-law principles. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of India.
Before initiating any formal proceeding, you agree to contact us at support@examinerly.com and attempt to resolve the dispute informally for at least 30 days.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you by email. Your continued use of the Service after the revised Terms are posted constitutes acceptance of the changes.
